Is Ohio's new abortion law gambling?

If a person wants to gamble, play casino classic.  Don't play around with legal issues.

What exactly is Ohio's abortion law?

Abotions are legal in Ohio up to 6 weeks, also known as the "heartbeat law".    Six weeks is six weeks from a woman's last period, or 2 weeks after missing their next period.   Unless a woman is new to getting their period, or they have non-regular cycles, most women know by 2 weeks after a missed period that they missed their period, and that they should take a pregnancy test.  Not to mention that by this point, most women start to feel morning sickness, so they know that something is not right.

There are exceptions if the women's life is in danger, for example, an Ectopic pregnancy.

There are no exceptions for rape or incest.

In terms of rape (unless the woman is not thinking correctly emotionally), you go to the police, hospital, doctor, emergency women's clinic, or if you are a child, even the school nurse.  This should be done right after the rape, so a formal police report can be filed, and a "rape kit" can be done.  The rape kit is crucial if you want to make sure the A-hole is put in jail for the maximum amount of time allowed by law.

Also, a pregnancy test can be given, and if the woman wants it, a morning-after pill can be administered.    Even if a woman decides she wants to keep the child or give the child up for adoption, knowing she is pregnant as early as possible is critical.

I can't speak for anybody else, but if I was a rape victim and I did not want to keep the child, I would at least want to know that my child was going to a good home that would love and care for the child as if it was their own.  The earlier that is taken care of, the better emotionally I would be to handle the pregnancy.

Is the Ohio 10 year old rape victim story true?

On June 10, 2022, a "Tre'Shawn L. Griffin, 23, was arraigned in Portage County Court of Common Pleas Friday on five counts of first-degree felony rape in a grand jury indictment. Judge Becky Doherty ordered the bond during the arraignment, with a condition that he have no contact with the girl."

"According to the indictment, Griffin allegedly raped the girl during a six-month period between Sept. 1, 2021 and March 1, when the girl was 10.  A warrant was issued for Griffin's arrest after the indictment was filed on May 16. Griffin was booked into Portage County Jail on Thursday morning, according to a jail booking log."  That is a period of 6 months when this 10 year little girl was raped again and again and again and again and again and again ...  you get the idea.

In Brazil, a 10 year old rape victim was denied an abortion by a judge and prosecutor.

"A serial rapist has been sentenced to 35 years in prison for sexually assaulting a 7-year-old across multiple states.  Joseph C. Gaines, 42, pleaded guilty in November 2021 to transporting a minor interstate with the intention of sexually abusing the victim, and committing a new offense against a minor as a registered sex offender, according to a release from US Attorney Kenneth Parker in the Southern District of Ohio. "

"Two men have been indicted by a Hocking County grand jury on charges that two years ago they both raped a 6-year-old child. " (April 17, 2021)

Bottom line is that bad people still exist in "good communities".

But the question that comes to my mind about the man who was charged on June 10, 2022 is "What happened on March 1, 2021 that caused the rapes of this young girl to stop?"  A man who was getting away with rape for 6 months is not going to stop of his own free will.  Did this girl finally have somebody tell her that rape is wrong and the guy should be put in jail?  Or did the girl get pregnant, and that is how the abuse finally stopped?  If it is the later, then yes and no this story is true.  Yes, it did happen to a 10 year old girl, but no, it did not happen in 2022, it happened in 2021.

What are the statistics on abortions by age in the US?

  • <15 years old - 0.2%
  • 15 - 19 years old - 8.5%
  • 20-24 years old - 27.7%
  • 25 - 29 years old - 29.2%
  • 30-34 years old - 19.6%
  • 35 - 39 years old - 11%
  • >40 years old - 3.7%

What are the abortion rates for women under the age of 15?

  • In 1973, 5.6 per 1000 women
  • In 1980, 8.5 per 1000 women
  • In 1990, 8.1 per 1000 women
  • In 2000, 4.4 per 1000 women
  • In 2020, 2.5 per 1000 women
  • In 2013, 1.6 per 1000 women

I don't know the exact reason why the numbers went up and then down, but part of it definitely has to do with the morning after pill.

In the <15 age group (14 and under), a vast majority of them are 14 year olds.

The average female will get their first period between 11 and 14 years of age, but getting your first period at 10 or 15 is still considered within the range of normal.

So is a 10 year old rape victim getting pregnant considered "within the range of normal (aka realistically possible)", the answer is yes.  If 10 year olds are getting raped and 10 year olds are getting their period, then 10 year olds can get pregnant due to rape.

What is the youngest age of woman can deliver a child?

5 years old.  "939: Lina Medina becomes the youngest confirmed mother in recorded medical history, delivering a son at the age of 5. The Peruvian child delivered a 5-pound, 8-ounce boy via caesarean section; her small pelvis made it impossible for the baby to pass through the birth canal."  Lina had her first menstrual cycle when she was only eight months old; her breasts were almost completely developed by the time she was 4.

"Lina’s condition, known as precocious puberty, was an extreme case, so much so that the story was dismissed as a hoax by many. But doctors X-rayed the fetus’ skeleton in utero and provided a picture of Lina, taken late in her pregnancy. The photograph, shot in profile, proves not only the pregnancy but shows the extent of her sexual development."

"The baby, a boy named Gerardo, was healthy. He grew up normally (his mother’s true identity was revealed to him when he was 10) but died at 40 from a bone-marrow disease."

"Paternity remains a mystery. Lina’s father was arrested on suspicion of rape and incest but the charges were later dropped for lack of evidence. Lina, who is still living, has never divulged a name and, indeed, may not know."

The son died in 1979, so given the technology that exists today, theoretically, it could be determined if the father was a relative, but it seems as if the mother does not want to learn the truth.

What should the law be?

In my opinion, cases like a 10 year old rape victim or even a 5 year old rape victim are outliers.  They will always exist, and they will always be the rare exception, but they will never go away.

The only solution that I can come up with is to create a committee where women can state their case in cases of rape, incest, severe birth defects, or a women's life being in danger.

1% of pregnancies are due to rape or incest.  10% are due to fetal abnormalities.  Ectopic pregnancies "Clinical presentation of ectopic pregnancy occurs at a mean of 7.2 weeks after the last normal menstrual period, with a range of four to eight weeks. Later presentations are more common in communities deprived of modern diagnostic ability. "

All of these cases are the exception, and the "right" answer is not an easy answer.  At first, the women may think that aboriton is the right choice to a point where they are willing to travel to another state to get one.  In some cases, like ectopic pregnancies, they may be right.

But in cases of rape, incest, or fetal abnormality, finding adoption parents and arranging the adoption right then and there (very short notice), may change a woman's mind.

Parents standing before the mother telling her that they will take care of her child and raise it and love it as their own, may be what the mother needs to hear to stop a women from gong to another state to get an abortion.  In rape cases (when the baby is healthy), finding adoption parents on short notice would not be too difficult.  But in cases of fetal abnormality, that may be more complicated (less volunteers).
